Kern County Coroner/Sheriff Says Bludgeoned Victim David Silva Died of "Hypertensive Heart Disease, Acute Intoxication, Chronic Alcoholism, Severe Abdominal Obesity, Chronic Hypertension and Acute Pulmonary Cardiovascular Strain."
May 23, 2013
[Editor's Note: This coroner's report is the work of Sheriff Donny Youngblood, who is both coroner and sheriff of Kern County (which should be against the law as there is clearly a conflict of interests here), although his name appears nowhere on the coroner's report. In fact the DEPUTY coroner's name is blacked out, as are the names and address of ALL Kern County officials involved in the report. The blatant and naked criminality involved in the cover-up and murder of David Silva by the Kern County Sheriff's Office is one of the most shocking case I've ever read. When such men are allowed to get away with this brazen level of murderous conduct, without federal intervention, then there is no hope for America. In the Rodney King beating, which did not result in death, the cops involved were at least indicted and went to trial, although not convicted. Rioting erupted in several American cities (notably South Los Angeles) and the cops were eventually re-indicted by a federal court and sentenced to prison. Twenty years later, the corruption of US "law enforcement" is now complete. An innocent, sleeping drunk man named David Silva, who had too much to drink on his birthday, was laying on the sidewalk (next to a grassy area) near the Kern County Medical Center. He was awoken by baton blows (ASP high carbon steel with a steel tip) and then had a police dog attack him. For the "crime" of trying to defend himself and stop the dog from biting him by holding the dog's neck, he was then savagely and repeatedly bludgeoned into unconsciousness by seven Kern County deputies and two CHP cops while still laying prone on the ground, unable to get up. His blood curdling screams to the police to stop beating him were simply ignored by ruthless men without a shred of humanity within them. His lifeless body was then allowed to bleed out for at least 20 minutes before medical personnel had arrived (finally taken to Kern Medical Center across the street), assuring no chance of his surviving the incident. Melissa Quair (foolishly) called the Kern County Sheriff's Office to tell them that she had just witnessed the frenzied and fatal attack upon Silva, who she could plainly see was now dead, and that she had recorded the entire event on her video cell phone. After (foolishly) giving her name and contact info, Kern County Sheriff detectives wasted no time in going to her home, and after refusing to give them the cell phone, and violating the 4th amendment of the US Constitution, detectives blocked the door to her apartment, holding her and her family hostage until a search warrant was obtained and then took the phone from her mother instead of asking for a copy of her video which Youngblood falsely claimed was his obligation to seize as "evidence" of a crime scene ("to be sure our officers are doing the right thing.") At the press conference, Youngblood, unsurprisingly, reported that "there was no video" on her cell phone. He had no idea if the video was deleted or not, he said. Melissa is likely one of the eye witnesses who is being pressured to change her story, as reported by 23 ABC News. .
23ABC News reported on May 9, 2013 the names of the seven Kern County deputies involved in the beating as:
1. Sgt. Douglas Sword
2. Dep. Ryan Greer
3. Dep. Tanner Miller
4. Dep. Luis Almanza
5. Dep. Brian Brock
6. Dep. David Stephens
7. Dep. Jeffrey Kelly
23ABC said the names of two CHP officers involved in the beating were not yet released.
BAKERSFIELD, Calif. - UPDATE: Sheriff Donny Youngblood said that the cause of death for David Silva was accidental. The coroner's report showed Silva to have died of cardiac hypertension. Youngblood said that there was amphetamine and methamphetamine found in Silva's system and that Silva had Vicodin and other drugs in his pocket.
Youngblood blames the media and says, "They raced to be first; not to be right." Youngblood continued saying that all of the baton strikes used by the deputies were within policy and none of the strikes were to the face or neck. He said, "The media is who controls the emotion." Youngblood continued saying that deputies had to have extra protection and guards as there were threats against them. Youngblood said that Silva's BAC was .095 and had methamphetamine, amphetamine, ethanol, clonazempam, and caffeine in his system. Youngblood said that during the struggle, a K9 was deployed and Silva grabbed the dog around the neck and began choking the dog. Youngblood said that only 3 of the deputies involved deployed any baton strikes. Chain Cohn Stiles, the law firm that represents the Silva family released a statement Thursday after the press conference.
Cohn said, "Our law firm has received a report from the Kern County Sheriff’s Office coroners report as it relates to the death of David Silva. Now that we have a copy of the report we will forward it to our experts. Our experts will conduct their own independent investigation to determine the cause and manner of death. We thank the community for the support of the Silva family.”
Sheriff Donny Youngblood is holding a press conference at 3 p.m. Thursday, regarding the alleged beating death of David Silva at the hands of his deputies. Silva was allegedly beaten to death on May 8 by Kern County Sheriff's Deputies. A search warrant obtained by 23 ABC shows Silva was in the triage area at Kern Medical Center several hours before the incident and was referred to the Mary K Shell Center across the parking lot. Sheriff's investigators asked the judge for the security camera footage from both facilities as well as any medical records.
The warrant shows detectives took footage from both and 32 pages worth of records from KMC. Detectives say they need the evidence as they try to determine if Silva was having a medical emergency or a mental health crisis at the time of his arrest. Sheriff Donny Youngblood has announced he will hold a press conference regarding the investigation on May Thursday at 3 p.m. Complete case details - http://www.turnto23.com/david-silva-in-custody-death . http://www.turnto23.com/news/live-video-press-conference-sheriff-donny-youngblood-discusses- silva-case-052313
