Fraud, Fraud, Fraud!

On the 23 of August I had a conversation on the phone which I happened to "record and monitor" for the court records purposes after, of course, giving notice to the "other party"(Municipal Court employees).

The two employees from the City of Las Vegas Municipal Court which I talked to were: "Sherry" (she did not want to give up her employee ID after I asked her several times). She asked me if I am a "private person" or an "Attorney", having difficulties believing that someone would ask for her name and Employee ID.

I asked her what is happening with Constantin and she said " He is to be seen on the 25th of August". I asked which judge and after some hesitation she told me "Department 2, judge Kolkosky".

I asked Sherry if Constantin had seen any judge today ( 23rd of August 2004) and her reply was : "YES, Department 2, judge Kolkosky, and HE PLEAD NOT GUILTY". I asked: " He plead not guilty?" and her reply was "CORRECT."

I asked her if she had this information on the computer and her answer was "YES".

I repeated the question one more time and she replied the same.

When asking her if she knew why Constantin is refusing to enter the contracts with judges or and court, she passed me to his co-worker "Rich", after more then a minute (listening to music of course while on hold).

Well, Rich didn't give me his employee number either.

I asked the same question: if Constantin saw a judge today, I got the same answer, and he added that Constantin would have had to say: "I am not guilty" in order for this to be registered as not guilty".

Now here is the recorded conversation over the phone (transcript) with Constantin later that night.

"This is Constantin, it's 11:55 pm, on Monday 23 August 2004, and I did not go to the Court date that was scheduled by whoever was scheduled. So, I did not appear in front of any judge or any court, I stayed all day in my cell no 334, unit 4 at the City Detention Center".

WELL, WEL, WELL.!!! This is all FRAUD!!!

They said that Constantin had seen a judge and plead not guilty, and Constantin said he did not see a judge and didn't appear in front of a judge. Also, I want to mention that court date events are on TV-VIDEO.

24th of August 2004.
I called the same office PRE-TRIALS and talked this time to BOB. What a conversation!!!

After he noticed that I was "monitoring and recording the conversation for records in the court", he got really pissed. He said that he doesn't understand my POOR English, my BAD ACCENT and also the connection is really bad.

I raised my voice a little bit, but he again said he doesn't understand me. He asked me to spell Constantin's last name. I did that: O, C, H. He asked 8? Ohhh well H sounds like 8 ( hehehehehe Bob, you were funny)

He asked for SS number and so on. Well, .he was trying to force me to hang up the phone on him. He did some more "tricks" on me ( he thought so), but I didn't fall for it.

He finally started to understand me very well, WOW Bob, My English improved in a matter of minutes and my BAD accent suddenly become exotic to you--- maybe--- ;-)?

But Hey! Nobody is perfect, I got to work on my cow-girl accent ;-)

After some chilling out, I asked my friend Bob what is happening with Constantin. He told me that he had 6 pre-trials and he will be scheduled again until he will cooperate. He said that Constantin's paperwork was in front of a judge. ( hmmmm.. C - not seeing a judge in flesh and blood anymore like his colleagues were telling me the previous day???)

Bob: "He (Constantin) is not doing what mental health people are asking him to do. He is refusing to co-operate"

Me: "What do you mean refuse to cooperate?"

Bob: "CO-OPERATION means you do what you are asked to do."

Me: "Even if it's against your will?"

Bob: " Yes, if it's against your will and if it's a mental health evaluation then they will hold you for that YEAH. Because that is an indicator from my side background that the person is not competent to appear in front of a judge, if he refuses to cooperate with a mental health person who is trying to determine whether they are competent or not."

After that I asked who is evaluating his mental health?

BOB said someone with a licensed medical contract under a jail medical contract. But then he really emphasized: HE NEEDS TO CO-OPERATE!" (I really appreciate your concern Bob).

Me: "If he doesn't?"

Bob: "WE'LL continue holding him or I don't know what will be applied to him whatsoever"

He also mention that from the past, on very rare occasions, people would not co-operate and that the judges will make a determination that he is not competent and send him to North Nevada, in-house Facility until he determines that he is competent. But that's rare. "It doesn't happen often"

We had some more chitchat together like old friends and after I apologized for not being understood (oh I really need to improve my accent ;-) we finished the conversation.

Now today, 24 August, Constantin received under the door a copy of a fax. The fax was from Department 2, Municipal Jail to City Jail.

Department 2 was asking that 3 inmates (one of them being Constantin) should call BELLON & MANINGO, an attorney's office between 2-5 pm. Are they trying to get an attorney to represent Constantin without his consent?

NOBODY HAS SEEN CONSTANTIN FOR MENTAL EVALUATION. HE NEVER APPEARED IN FRONT OF A JUDGE.

FRAUD!! FRAUD!! FRAUD!!!
