Hi Kate,

Thanks for letting me know about the Dan Winter web site takeover. Dan moved to France some years ago because of Stan Tenen.'s litigation harassment. I always had a good impression of Dan Winter's work and research. I don't' really know the facts of this case, so I can't form an opinion on the merits of Tenen's claims. However, I don't accept the idea that some judge can simply commandeer someone's web site because Plaintiff Tenen has a civil judgment against Defendant Winter and then turn it over to the Plaintiff so he can now use Winter's own web site to tell his readers what a rat he is. That's really exceeding judicial authority by a wide margin. Civil libertarians need to look into this one and call that judge on exceeding his authority.

You have to remember that Dan Winters has been living in France all this time and all of these court decisions are made with only Tenen and his lawyers in court against a defendant who's not there and acquiring one default judgment after another.

It's entirely possible that Winter doesn't have the kind on money necessary to fight Tenen and his foundation and it was a matter of getting out of the country to avoid further losses and the mental strain of court litigation. It's not fun losing every dime you have to lawyers trying to defend yourself when the opposition has the bigger guns. Try fighting a big corporation or the government sometimes if you want to learn about how lopsided "justice" can be.

Again, I don't know the facts of the case and Dan Winter may be in the wrong, but I wouldn't conclude that until I read the case and court documents and talked with everyone involved to know for sure. My impression of Dan Winter is that he's a good guy and does some amazing research work. Remember, you're only seeing Tenen's side of the story.
